Bin Bringers Terms and Conditions

  1. Definitions

“The Company ” – refers to Bin Bringers LLC and/or any franchisees trading under a franchisee agreement

“Worker” – refers to the person or firm carrying out Bin Bringing Services on behalf of the Company.

“Client” – refers to the person, firm or corporate body together with any subsidiary or associated company as defined by the Companies Act 1985 to whom the power washing services are supplied by the Company.

“Service” – refers to one performance of any service included in “Bin Bringing Service” as described bellow, and carried out by, or on behalf of, the Company.

“Scheduled service” – refers to a Service scheduled by the Company per Client’s request and consent.

“Plan”- refers to a subscription product offered by the Company, billed monthly, regardless of service usage. Prices vary by Plan variation and additional options.

“Bin Bringing Service” – refers to The Company’s service which includes the transferring or transporting of trash cans or bins from their designated on-property location to the curb or designated collection point on the day prior to the client’s trash and/or recycling collection day. Additionally, the service includes the transferring or transporting of trash cans or bins from the curb or collection point to the client’s designated trash/recycling can storage area. This service may include one or both directions of transportation.

“Bin” or “Can” – All references to “Bin” or “Can” refer to any waste or recycling receptacles, that are approved or acceptable for use by local laws or regulations, for the purpose of waste collection, and are less than 100 Gallons in size.

  1. Contract

2.1. These Terms and Conditions represent a contract between Bin Bringers LLC and The Client.

2.2. The Client agrees that any use of The Company’s services, including placing an order for services by telephone, email, text/SMS, or website forms shall constitute the Client’s acceptance of these Terms and Conditions.

2.3. Unless otherwise agreed in writing these Terms and Conditions shall prevail over any other terms of business or purchase conditions put forward by The Client.

2.4. No variation or alteration of these Terms and Conditions shall be valid unless approved in writing by a director of the Company.

2.5. The Company operates depending on the hours required to get the service done.

  1. Customer Responsibilities & Permissions

3.1.  The Client is responsible for ensuring unimpeded access to all locations necessary for service provision. Failure to provide timely access for any reason, including but not limited to, inaccessibility caused by or related to weather conditions, natural disasters, construction, or other unforeseen events, shall be the sole responsibility of the Client and may result in non-refundable service interruptions. If the Worker cannot access required locations within 5 minutes of arrival, service may be forfeited for that day. Any subsequent attempt may incur additional fees and is subject to availability.

3.2. The Client is responsible for ensuring that all receptacles used for collection purposes comply with local laws and regulations, including but not limited to, health and safety standards, environmental regulations, and waste management ordinances. Additionally, the Client must ensure that receptacles are not overfilled beyond their designated volume or weight capacities, as this may result in additional fees, or service disruptions.

3.3.  By selecting this service, the Client grants explicit permission to the Company and its authorized workers, agents, and contractors to enter and operate vehicles on all private roads, driveways, and access ways necessary to reach the designated waste collection bins and their collection points. This permission includes, but is not limited to, the right to drive on and cross private property, access alleys, and enter gated communities, as needed. The Client acknowledges that they have the authority to grant such permission and agrees to hold harmless the Company and its workers for any claims or damages related to vehicle access, provided they are acting within the scope of their duties and in compliance with applicable laws and regulations.

3.4.  By selecting this service, the Client grants explicit permission to the Company and its authorized workers, agents, and contractors to handle their trash and recycling bins and cans, and any gates, doors, sheds, locks, or other obstacles that need to be accessed to retrieve the bins. We will exercise utmost care in handling these items to ensure safe and successful bin placement. However, we disclaim responsibility for any damage to bins, gates, doors, sheds, locks, or other obstacles due to pre-existing conditions or wear and tear, or breakage. Our liability is limited to exercising reasonable care in handling the bins and accessing the area where the bins are located, and we are not responsible for any damage or issues arising from circumstances beyond our control.

  1. Service boundaries and limitations

4.1. The Company’s Bin Bringing Service only applies to trash and recyclables that are contained in receptacles approved by the local municipality. Loose trash/recyclables, or trash/recyclables in non-approved containers, including but not limited to: loose items, bags, cardboard boxes, or other vessels, are excluded from service, unless explicitly agreed upon in writing. Requests for exceptions may be subject to additional fees, and availability, and must be submitted 24 prior to next Service.

4.2. The Bin Bringing Service is exclusive to household trash and recyclables. Yard waste, construction waste, and hazardous waste are explicitly excluded, even if placed in household waste receptacles. The Company reserves the right to disregard receptacles if the Worker reasonably suspects they contain excluded waste. Special requests for removal or transfer of excluded waste may be accommodated upon written request, and may be subject to availability and additional fees. 

4.3. Our service is designed for bins or cans with a maximum capacity of 100 gallons. If your bins or cans exceed this limit, we reserve the right to deny service or charge additional fees.

4.4. In the event of holidays, extreme weather conditions, natural disasters, or other disruptions affecting trash or recycling collection, the Company will reschedule service to the next appropriate day. While the Company will make reasonable efforts to stay informed about collection schedule changes, it cannot guarantee the accuracy of information provided by third parties. Clients with private collection service are encouraged to share any updates regarding changes to their collection schedule to ensure seamless service. 

4.5. The Company reserves the right to cancel service if conditions are deemed too hazardous to operate safely.

  1. Payment

5.1. All work carried out by The Company at your request, whether experimental or otherwise will be charged accordingly. Any work undertaken by The Company on behalf of The Client is carried out on the basis that The Client has fully approved such work whether or not we have received an official order providing there is evidence of written or verbal confirmation to proceed, including letter, facsimile, text/SMS or email correspondence between the parties.

5.2. Payments of fees rendered by invoice are due within the dates stated on the invoice.

5.3. We will issue invoices monthly upon completion of service or request a deposit before starting the service, depending on the agreed-upon terms and conditions.

5.4. All prices are Net and no settlement discount is allowed unless stated. All accounts are payable no later than 7 days from date or invoice unless otherwise agreed by The Company in writing. Note that the payment terms are required whether you have signed off on the copy or not.

5.5. After the 7 day payment period has passed all further work for The Client will cease unless there’s a another agreement of payment period.

5.6. All quotations offered by us are deemed valid for a period of 30 (Thirty) days, after which time we reserve the right to revise the said quotation.

5.7. We provide services on a one-off and retainer basis.

5.8. Payment for recurring services shall be collected automatically via the credit card provided by the Client and stored on file. By furnishing a credit card for recurring services, the Client thereby authorizes the Company to charge the credit card for the recurring service fee, as well as any additional fees incurred or services requested by the Client, unless otherwise agreed in writing. 

5.9. It is the Client’s responsibility to ensure that their credit card information remains up-to-date and accurate, and to notify the Company of any changes or updates in a timely manner. Failure to do so may result in interrupted or terminated service.

5.10. Any additional work requested that isn’t covered in the original brief will be quoted separately and added to the original invoice. One month’s notice is required to discontinue the service.

5.11. Bin bringing service prices are reviewed each year and adjusted in line with inflation, minimum wage increases or any reasonable circumstances.

  1. Refunds

6.1. No refund claims will be given once the service has been carried out. If for any reason the Client is dissatisfied with any aspect they must notify the Company within 24 hours and this will be rectified.

6.2. Refunds will only be issued if the Company fails to provide or rectify an unsatisfactory scheduled service. The refund amount will be determined by the pro-rated cost of the missed or unsatisfactory service, calculated as a proportion of the monthly cost.

  1. Cancellation

7.1. Plans may be canceled at any time. If a plan is canceled mid-month, a pro-rata refund will be issued for the unused portion of the monthly fee. Notification of cancellation must be received by us at least 24 hours prior to the upcoming service to prevent being charged for unwanted service. The pro-rata refund will be calculated by subtracting $10 for each service already performed that month, prior to cancellation.

7.2. The Client agrees to pay the full price of the scheduled service if they: (i) cancel or reschedule with less than 24 hours’ notice, (ii) fail to provide access to the service premises, or (iii) fail to provide functional keys or codes, resulting in the Worker’s inability to access required locations without special effort or skill.

7.3. If the Client needs to change a service day or time the Company will do its best to accommodate them. A minimum of 24 hours notice is required. Please note that the Company cannot guarantee that the same operative will be available on the new day and at the time the Client requires. Any changes to the service schedule are subject to availability.

  1. Promotions and Discounts

8.1. Promotional offers may be offered from time to time. Rules and regulations of promotions may override the general Terms of Service for  the duration of the promotional offer.

8.2. The Company retains the right to cancel or modify any promotion at any given time.

8.3. All promotional offers are subject to the terms and conditions that accompany the specific promotion.

8.4. The Company reserves the right not to honor a promotional rate in the event of suspected fraudulent activity or usage not in accordance with the Company’s Terms of Service.

  1. Complaints

9.1. All complaints are taken seriously. If you are not happy with any aspect of our service please call us as soon as possible and give us the chance to rectify it. Your satisfaction is very important to us, please allow us please allow us the opportunity to make it right. We value your feedback and will work diligently to resolve any issues and ensure your experience with us meets your expectations.

9.2. If the Client is dissatisfied with a currently occurring service, the Company kindly requests prompt notification. Please call us at +1 732-242-4172 as soon as you notice anything that might be to your dislike. Notifying us as soon as possible allows us to address your concerns in a timely manner.

  1. Liability

10.1. The Company shall not be liable under any circumstances for any expense, damage, delay, costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by the Client arising from or in any way connected with a late arrival of Company operatives at the service address. The Company endeavors to be right on time on any scheduled service but sometimes due to transport related and other problems which are beyond the Company’s control, the Company operative’s may arrive with a delay or the service may be rescheduled.

10.2. The Client is responsible for any violations, damages, penalties, or legal liabilities resulting from failure to comply with local laws and regulations regarding waste receptacles’ capacities, quality, storage location, or collection points. By using our services, the Client acknowledges that they are responsible for ensuring compliance and agrees to hold harmless the Company for any violations or damages resulting from their failure to do so.

10.3. The Company shall not be liable under any circumstances for any loss, expense, damage, delay , costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by the Client arising from or in any way connected with – 1. Third party entering or present at the Client’s premises during the performance of service; 2. Any pre-existing damage to Clients property, bins, doors, gates, or storage units or facilities in the form of broken or missing parts or handles etc.

  1. Supplementary Terms

11.1. The Company reserves the right to re-evaluate rates at any time should the Client’s initial list of tasks changes.

11.2. The Company reserves the right to amend the initial quotation, should the Client’s original requirements change.

11.3. The Company reserves the right to make reasonable changes to the Terms and Conditions in agreement with the other party.
